PRIVACY POLICY

WHO WE ARE
BCG Water LLC (“BCG Water,” “we,” “us,” or “our”) provides contract water and
wastewater system operations, regulatory compliance support, and technical
consulting services. We operate in California and North Carolina and serve
water systems, wastewater systems, and the property owners and operators
responsible for them.
This policy explains what personal information we collect, why we collect it,
who we share it with, and the choices you have. It applies to bcgwater.com, to
the client portal we make available to our clients and their designated
contacts, and to the phone, text message, and email communications we send in
the course of our work.
THE SHORT VERSION
We collect the contact information and operational records we need in order to
operate your water system and keep it in compliance. We do not sell personal
information. We do not share mobile phone numbers or text messaging consent
with anyone for marketing purposes. We use a small number of service providers
(listed below) to deliver our services, and we hold them to confidentiality
obligations.
INFORMATION WE COLLECT
Information you give us directly
Name, job title, and the organization you represent.
Business email address, business phone number, and mobile phone number where
you have provided one.
Mailing address and billing contact information.
Account credentials and access preferences for the client portal.
Anything you write to us in an email, a text message, a portal message, or a
voicemail.
Information we collect while operating your system
Field observations, meter readings, and log sheet entries recorded during
site visits.
Laboratory sample results and chain of custody records.
Regulatory filings, correspondence with regulatory agencies, and permit
documentation.
Photographs of equipment, facilities, and site conditions.
Records of the tasks, obligations, and reports associated with your system.
Most of this is operational and technical information about a water system
rather than personal information about an individual. Where it names an
individual, for example the operator who recorded a reading or the contact who
approved a filing, we treat it as personal information under this policy.
Information collected automatically
Basic technical information when you visit bcgwater.com or the client portal:
IP address, browser type, device type, pages viewed, and the date and time of
access. We use this to keep the site working and secure.
Cookies and similar technology strictly necessary for signing in to the
client portal and keeping your session active. We do not use advertising
cookies and we do not run third party advertising trackers.
Information from third parties
Laboratory results delivered to us by the analytical laboratories that test
your samples.
Regulatory correspondence and public records from state and county agencies.
Telemetry and instrument data from equipment installed at your facility.
HOW WE USE INFORMATION
To operate, monitor, and maintain the water and wastewater systems we are
contracted to serve.
To prepare, submit, and retain regulatory reports and compliance records.
To communicate with you about your system, including scheduled visits,
sample results, alerts, deadlines, and questions that require your decision.
To provide the client portal and show you your own facility’s records.
To prepare invoices, track billable time, and administer our agreement with
you.
To maintain the audit and history records that regulatory compliance
requires, including who recorded a value and when it was corrected.
To improve our services and the tools we use to deliver them.
To comply with law, respond to lawful requests, and enforce our agreements.
We do not use your personal information to build advertising profiles, and we
do not make automated decisions about you that have legal or similarly
significant effects.
TEXT MESSAGING
Where you have given consent, we send text messages to the mobile number you
provided. These are operational and account related messages, not marketing
campaigns. Typical messages include sample results, monitoring alerts, filing
deadlines, scheduling, and direct one to one messages from a BCG Water team
member about your system.
Consent to receive text messages is not a condition of purchase or of any
service we provide.
Message frequency varies with the activity on your system. Message and data
rates may apply, depending on your mobile plan and carrier.
To stop receiving text messages, reply STOP to any message from us. To resume,
reply START. For help, reply HELP or contact us using the details at the end of
this policy.
Mobile information will not be shared with third parties or affiliates for
marketing or promotional purposes. Information sharing is limited to
subcontractors providing service delivery, such as messaging providers, and
those providers may use the information only to deliver our messages.
Text messaging consent, mobile numbers, and opt out records are never sold,
rented, licensed, or disclosed for anyone else’s marketing use, and they are
not shared with data brokers or lead generators.

HOW WE SHARE INFORMATION
We share personal information only in these circumstances.
Regulatory agencies. Compliance reporting requires us to submit records to
state and county regulators on your behalf. This is the purpose of much of the
information we hold.
Analytical laboratories. We share sample identification and site information
with the laboratories that analyze your samples.
Service providers. We use a small number of vendors to run our business and
deliver our services. Each is bound by contract to protect the information and
to use it only to provide services to us. They include, and may change over
time:
Microsoft (email, calendar, file storage, telephony, and text messaging for
our staff numbers)
Our messaging provider for platform notifications
Our cloud hosting and database providers
Intuit QuickBooks (invoicing and accounting)
Our password management provider
Professional advisors. Attorneys, accountants, and insurers, where needed and
under a duty of confidentiality.
Business transfers. If BCG Water is involved in a merger, acquisition, or sale
of assets, information may transfer as part of that transaction. We would
notify you before your information became subject to a different privacy
policy.
Legal requirements. Where we are required by law, subpoena, or court order, or
where disclosure is necessary to protect the safety of a person or the security
of drinking water infrastructure.
WE DO NOT SELL PERSONAL INFORMATION, and we have not sold or shared personal
information for cross context behavioral advertising in the preceding twelve
months.
HOW LONG WE KEEP INFORMATION
Compliance records, log sheets, laboratory results, and regulatory filings are
retained for the period required by the applicable regulation or permit, which
is commonly several years and in some cases longer. Where a regulation sets a
retention period, that period governs.
Business records such as contracts, invoices, and correspondence are retained
as long as needed for the relationship and for tax and legal purposes.
Text messaging consent and opt out records are retained for as long as we
message you and for a reasonable period afterward, because the record that
consent existed is itself the evidence a carrier or regulator may ask for.
Records we no longer need are deleted or archived. Compliance records are
corrected rather than erased, and a correction keeps its own history, because a
record that can be silently changed is not a record.
SECURITY
Access to client information is limited to the people who need it to do their
work. Portal access is scoped so that a client sees only their own facility’s
records, and that limit is enforced by the database on every request rather
than only in the interface. Staff sign in with managed accounts, and
credentials are held in a password manager rather than in documents or
messages. Data is encrypted in transit.
No system is perfectly secure. If we become aware of a breach affecting your
personal information, we will notify you and any regulator as required by law.
YOUR CHOICES AND RIGHTS
You may, at any time:
Ask us what personal information we hold about you.
Ask us to correct information that is inaccurate.
Ask us to delete information, subject to the retention obligations described
above. We cannot delete a compliance record we are required to keep.
Withdraw consent to text messages by replying STOP, or to email
notifications by telling us.
Ask for a copy of your information in a portable format.
California residents. Under the California Consumer Privacy Act as amended by
the California Privacy Rights Act, you have the rights to know, delete,
correct, and to opt out of sale or sharing, and the right not to be
discriminated against for exercising them. We do not sell or share personal
information as those terms are defined. To exercise a right, contact us using
the details below. We will verify your request by confirming your identity
through the contact information we already hold for you. You may use an
authorized agent, and we will ask for proof of authorization.

CHILDREN
Our services are directed to businesses and public agencies. We do not
knowingly collect personal information from anyone under 18. If you believe a
minor has provided us information, contact us and we will delete it.
CHANGES TO THIS POLICY
We may update this policy. When we do, we will change the effective date at the
top and, if the change is significant, tell you directly. Continued use of our
services after a change means you accept the updated policy.
